Ocado has won a trade case brought forward by its warehouse robot maker AutoStore that threatened its plans to expand its robotic warehouses into the US.

AutoStore is looking to appeal in a US federal court an International Trade Commission’s (ITC) decision on a patent row with online grocer Ocado.

AutoStore has provided storage technology to Ocado and has been involved in legal battles over intellectual property (IP) rights.

ITC labelled three of the four AutoStore patents as invalid and said that the fourth one was not infringed by Ocado.

“We welcome the ITC’s decision, which comprehensively confirms the judge’s original findings last December,” Ocado said.

AutoStore in a statement said it “believes strongly in its litigation positions and will continue to pursue them”.
