When news broke that Marks & Spencer had launched legal action against Aldi in an effort to protect its iconic Colin the Caterpillar cake, social media users had a field day.
M&S had lodged an intellectual property claim arguing that the similarity of Aldi’s Cuthbert the Caterpillar product leads consumers to believe they are of the same standard.
M&S also argued that Aldi’s product would “ride on the coat-tails” of M&S’s reputation with Colin the Caterpillar.
